China Tariff Exclusions Extended for 81 COVID-Related Goods – Update

Exclusions from the Section 301 tariffs on imports from China for 81 medical care products needed to address the COVID-19 pandemic have been extended from Feb. 28 through May 15, 2023. These exclusions are available for any product that meets the specified HTSUS numbers and product descriptions, regardless of whether the importer filed an exclusion request.


In addition, the Office of the U.S. Trade Representative is accepting comments through March 7 on whether to extend some or all of these exclusions for up to another six months.


In the meantime, USTR is evaluating comments submitted as part of a review of all Section 301 tariffs on imports from China, which could result in changes to those tariffs later this year.

USTR Extends Exclusions from China Section 301 Tariffs

The Office of the United States Trade Representative announced a nine-month extension of 352 product exclusions with a
updated expiration date of 9/30/2023 in the China Section 301 Investigation that had been scheduled to expire at the end
of 2022. These exclusions were initially reinstated on March 28, 2022 and the extension will help align further consideration
of these exclusions with the ongoing comprehensive four-year review.
Interested persons may submit comments on the tariff headings containing these exclusions through the USTR portal in the
four-year review, which closes January 17, 2023.

the specified HTSUS numbers and product descriptions, regardless of whether the importer filed an exclusion request.
The Office of the U.S. Trade Representative states that it may consider further extensions and/or additional modifications in the
future. In the meantime, USTR is accepting comments through Jan. 17 as part of a review of all Section 301 tariffs on imports
from China
